من یک مشاور مهاجرت به کانادا هستم. دفتر مهاجرت من در شهر تورنتو در انتاریوی کانادا واقع است. تخصص من در مهاجرت همجنسگرایان به کانادا است. به خیلی از کانادایی ها یا مقیمان دائمی کانادا کمک می کنم که ضامن پارتنر همجنس خارجی خود برای مهاجرت به کانادا در رده ی درخواست های خانوادگی بشوند. همچنین به بسیاری از همجنسگرایان خارجی کمک می کنم تا به تنهایی یا به همراه پارتنر خود با درخواست رده ی اقتصادی به کانادا مهاجرت کنند. از سال 1994 که برای پارتنر خودم اقامت دائم به عنوان پارتنر قانونی ام گرفتم به زوج های همجنسگرا برای مهاجرت به کانادا کمک می کنم. در سال 2005 شرکت مهاجرت خود را به نام "پیوند مهاجرت" (Immigration Link)  راه اندازی کردم. عضو "جامعه کانادایی مشاورین مهاجرت" CSIC هستم. این سازمان به تازگی برای سامان دهی به مشاورین مهاجرت و محافظت از مراجعان آنها ایجاد شده است. اعضا موظفند در یک آزمون سخت در تمام مسایل مهاجرت به کانادا موفق شوند و همچنین آزمون زبان انگلیسی یا فرانسوی را نیز پشت سر بگذارند. اعضا همچنین باید بطور دائم دانش و مهارت خود را ارتقا دهند.

من همچنین عضو انجمن مشاوران حرفه ای مهاجرت کانادا (CAPIC) هستم. این سازمان برای کسانی است که در زمینه ی امور مهاجرت کار می کنند. این سازمان تلاش می کند تا اعضایش را با برنامه های آموزشی یک وب سایت و سمینار با دولتمردان به روز نگه دارد. من نایب رئیس کمیته آموزشی شعبه ی انتاریو که بزرگترین شعبه CAPIC می باشد هستم.

در اولین سال تحصیلی بعد از تصویب قانون جدید مهاجرت (قانون حمایت از مهاجران و پناهندگان IRPA ) در برنامه ی مدرک شاغلین مهاجرت در کالج سنکا در تورنتو تحصیل کردم. این بهترین برنامه ی آموزشی درباره ی مهاجرت به کاناداست و دشوار بود و من با نمرات بالا  فارغ التحصیل شدم. همچنین سه مدرک کارشناسی دارم: کارشناسی هنر در روان شناسی و تاریخ، کارشناسی ریاضی، و کارشناسی MBA.

پارتنرم به من می گوید که خوب است اطلاعاتی درمورد زندگی شخصی خودم نیز بنویسم. من در کیپ برتون در نووا اسکوتیا متولد و بزرگ شد ه ام. در آنجا نمی شد راجع به گرایش جنسی آشکارا حرف زد اما حتی در آن زمان نیز شرایط مانند اختناقی که اکنون در ایران هست نبود. بعدها به تورنتو رفتم چون بزرگترین و متمایزترین جامعه ی همجنسگرایان کانادا را دارد. من در جامعه ی همجنسگرایان تورنتو در کمیته افتخار، گاهنامه ی محلی همجنسگرایان، خط تلفن بحران دگرباشان، و یک گروه مهاجرت فعالیت می کردم. ما یک گربه داریم به اسم Mr. Right که قبل از آشنایی با پارتنرم به دست من رسیده است. ما با هم در قلب جامعه ی همجنسگرایان در مرکز تورنتو زندگی می کنیم. قوانین حقوق همجنسگرایان در کانادا از زمانی که من نوجوان بودم و فکر می کردم که تنها همجنسگرای دنیا هستم تغییرات زیادی کرده اند.

Cheraq and IRQO have had many enquires about Canadian immigration and we now have an opportunity to bring to you a column by one of Canada’s most experienced immigration professionals on the subject of Canadian immigration for gays and lesbians, Mr Peter Bernier. Mr Bernier will now introduce himself and give you an idea of what his column will be like and how you can help him make it as useful to you as possible.

I am a Canadian immigration consultant with my own immigration business in Toronto, Ontario, Canada, specializing in Canadian immigration for gays and lesbians. I help many Canadian and Canadian Permanent Residents sponsor their foreign same sex partner for immigration to Canada on Family Class applications. I also assist many foreign gays and lesbians immigrate to Canada on their own or with their same sex partners on Economic Class applications. I have been assisting same sex couples with Canadian immigration since 1994 when we got my partner his permanent residence as my common-law partner. We have just passed our 14½ year anniversary. In 2005 I started my own immigration firm – Immigration Link (www.gayimmigration.ca or www.lesbianimmigration.ca) .

I am a member of the Canadian Society of Immigration Consultants (CSIC  http://www.csic-scci.ca ). This organization was recently set up to regulate immigration consultants and protect the consumers. It requires members to pass a stringent test on all aspects of Canadian immigration as well as to pass a language test in either French or English. Members must also continually upgrade their knowledge and skills.

I am also a member of the Canadian Association of Professional Immigration Consultants (CAPIC   http://www.capic.ca ). This is an organization for people who work in the immigration field. It works to keep its members up to date with educational events, a website and seminars with Government officials. I am the Co-Chair of the Education Committee of the Ontario chapter, the largest CAPIC Chapter.

I studied the Immigration Practitioners Certificate Program at Seneca College in Toronto the first academic year after the new immigration law (Immigration and Refugee Protection Act [IRPA]) came into effect in 2002. This program is the best one available on Canadian immigration and it was tough. I graduated with High Honours.  As well I have three Bachelor degrees: Bachelor of Arts in Psychology and History; Bachelor of Science in Mathematics; and Bachelor of Business Administration in Marketing.

My partner said I should give a little more personal information as well. I was born and brought up in Cape Breton, Nova Scotia. It was not a place you could be open about your sexuality but even then was not as repressive as it is in Iran now. I later moved to Toronto as it had and still has Canada’s largest and most diverse gay and lesbian community. I have been active in our community in Toronto with the Pride Committee, the local gay periodical, the LGBT crisis phone line, and an immigration group. We have a cat called Mr Right that I acquired just before meeting my human “Mr Right”. We live together in the heart of the gay community in downtown Toronto. Canadian gay and lesbian rights have come a long way since I was growing up wondering if I was the only one.

In this series of columns on Canadian immigration written especially for gays and lesbians I will concentrate on topics that are of importance to gays and lesbians wanting to immigrate to Canada. I will base the columns on topics that I know from experience you should know about but probably wouldn’t know to ask about, topics that you ask about, and topics that may come up in the news or elsewhere from time to time. Next month the topic of my column is a brief overview of Economic Class immigration applications. You may find that you do qualify for one of the four types of applications.

Since I have a bit more space I thought I would mention something that relates to CSIC. The law requires that anyone paid by you to assist you with your immigration application must be either a member of CSIC or a Canadian lawyer. This is to protect you, the consumer. Canadian Immigration is required to return, unprocessed, any application received where the applicant paid someone that was not a CSIC member or a Canadian lawyer to help them. No one else is accredited to advise you or represent you to Canadian Immigration for a fee. You may deal with an agent of a CSIC member or Canadian lawyer but the agent is not permitted to advise you. They are only allowed to be a go-between you and your legal representative. Before hiring someone to help you, you should make sure they are a member of CSIC or a Canadian lawyer. You can do this by checking the members list on the CSIC website http://www.csic-scci.ca/find/ or Canadian Law List (CLL) http://www.canadianlawlist.com/Pages/CLLterms.html website. You should also check to see if they are experienced in the type of application you are doing.

Otherwise, as long as they are not paid, anyone can assist you with your application.
